In July 2019, Stella Creasy MP and her team succeeded in attaching an amendment to a largely administrative bill which would require the UK government to liberalise abortion laws in Northern Ireland by 21 October 2019, provided the Northern Ireland government does not resume before that date.1 The amendment succeeded in the Commons, 332 votes to 99 and later, with some adjustments, in the Lords, 182 votes to 37. The Bill received Royal Assent on 24 July 2019. In Northern (...) Ireland, abortion remains a criminal offence punishable by up to life imprisonment in all except exceptional circumstances, that is, where it is ‘necessary to preserve the life of the woman’ or where there is a ‘risk of serious adverse effect which is either long term or permanent’.2 The law makes no provision for women who are pregnant as a result of rape, incest or in the case of fatal fetal abnormality. Because there is a lack of clarity around which circumstances or conditions would have a sufficiently ‘serious and long-term adverse effect’, it has been argued that the law has had a ‘chilling effect’ on service provision.3 As a result, only 13 abortions were performed in Northern Ireland in 2018/2019.4 Instead, more than 1000 women travelled from Northern Ireland to England to access legal abortion services.5 A recent review of the law in Northern Ireland concluded that this situation disadvantages women who cannot afford to or are unable to travel.3 Women are also reportedly purchasing abortifacients unlawfully online, exposing them to the risk of prosecution as well as to risks where the pills are unsafe or lead to complications. Semantics is a bridge discipline between linguistics and philosophy; but linguistics student are rarely able to reach that bridge, let alone cross it to inspect and assess the activity on the other side. Professor Kempson's textbook seeks particularly to encourage such exchanges. She deals with the standard linguistic topics like componential analysis, semantic universals and the syntax-semantics controversy. But she also provides for students with no training in philosophy or logic an introduction to such central topics in the philosophy of (...) language as logical form, truth, speech acts, analyticity, entailment and presupposition. The exposition throughout is deliberately argumentative rather than descriptive, introducing the student step by step to the major problems in theoretical semantics. Incentives are typically conceived as a form of trade, and so voluntariness appears to be the only ethical concern. As a consequence, incentives are often considered ethically superior to regulations because they are voluntary rather than coercive. But incentives can also be viewed as one way to get others to do what they otherwise would not; that is, as a form of power. When incentives are viewed in this light, many ethical questions arise in addition to voluntariness: What are the (...) responsibilities of the powerful in using incentives? Can incentives be manipulative or exploitative, even if people are free to refuse them? Like all other forms of power, incentives can be abused. This paper develops criteria for distinguishing their legitimate from their illegitimate uses, viz. legitimacy of purpose, voluntariness, and effect on character. I try to focus our differences by examining the relation between what Dennett has termed "the intentional stance" and "the design stance." Dennett takes the intentional stance to be more basic than the design stance. Ultimately it is through the eyes of the intentional stance that both human and natural design are interpreted, hence there is always a degree of interpretive freedom in reading the mind, the purposes, both of Nature and of her children. The reason, or at least a (...) reason, is that intentional interpretation is holistic, hence indeterminate, for the kinds of reasons given by Davidson and Quine. In contrast, I take the design stance to be more basic than the intentional stance. Intentional attributions express our best guesses about the locations of effects of certain kinds of natural design. And although there is often indeterminacy, ambiguity, or vagueness concerning what it is that natural selection (or learning) has selected for, these indeterminacies and vaguenesses are local, not holistic. There is reason to suppose that the better portion of Nature's purposes and the intentional states of her children are determinate in content within quite closely defined limits. I propose to defend this position as well as I can, so as to call from Dennett his own views on precisely where our paths separate (if they really do). (shrink)

Pervasive though it is in modern life, the concept of self-esteem is often viewed with distrust. This paper departs from an idea that was recently aired by Richard Smith: that we might be better off without this concept. The meaning of self-esteem is explored within four ‘homes’: the self-help industry, social science, therapy and education. It is suggested that the first two use a ‘simple’ concept of self-esteem that indeed we are better off without. This concept eliminates the distinction between (...) truthfulness and delusion, and relies on a chimera of quantifiability. The much richer concept of situated self-esteem is explored, and it is argued that low self-esteem in children (often narcissistically disguised) should command the attention of educators. Teachers should address this through education and communication, and reject the idea (prevalent in the USA) of boosting self-esteem through a content-free curriculum. (shrink)

While it is uncontroversial to point to the liberal roots of feminism, a major issue in English-language feminist political thought over the last few decades has been whether feminism's association with liberalism should be relegated to the past. Can liberalism continue to serve feminist purposes? This book examines the positions of three contemporary feminists - Martha Nussbaum, Susan Moller Okin and Jean Hampton - who, notwithstanding decades of feminist critique, are unwilling to give up on liberalism. This book examines why, (...) and in what ways, each of these theorists believes that liberalism offers the normative and political resources for the improvement of women's situations. It also brings out and tries to explain and evaluate the differences among them, notwithstanding their shared allegiance to liberalism. Ethische Leitlinien für die klinische Praxis erfreuen sich zunehmender Beliebtheit. Damit klinisch-ethische Leitlinien aber überhaupt erfolgreich wirksam werden können, ist noch Pionierarbeit zu leisten. Solche Leitlinien müssen wissenschaftlich stärker fundiert und ihre praktische Anwendbarkeit muss verbessert werden. In dieser Arbeit werden die ersten Schritte des Projekts METAP zur methodischen Entwicklung und praktischen Implementierung einer Leitlinie für eine patientengerechte Versorgung am Krankenbett beschrieben und zur Diskussion gestellt. Das Projekt orientiert sich methodisch an der Entwicklung medizinischer Leitlinien und generiert damit eine forschungs- (...) und konsensgestützte Leitlinie, die systematischer Evaluation und Modifikation unterliegt und Rechenschaft über ihre wissenschaftliche Fundierung gibt. Zusätzlich zur Leitlinie bietet das Projekt in der Form eines Handbuchs ein Entscheidungsfindungsverfahren an, welches unter anderem deliberative Aspekte unterstützt. Das Handbuch konzentriert sich auf ethische Fragen der Mikroallokation und liefert darüber hinaus Informationen über empirische, ethische und rechtliche Grundlagen für Therapieentscheidungen. Anhand eines Eskalationsmodells können unterschiedliche Instrumente nach Bedarf als ethische Lösungsstrategien eingesetzt werden, von der Kurzfassung im Kitteltaschenformat („Leporello“) mit den wichtigsten Fakten, weiterführenden Texten und Empfehlungen mit normativen und prozeduralen Hinweisen, über stationsinterne Lösungsversuche bis hin zum Ethikkonsil. Klinische Partner sind von Beginn an aktiv in den Entwicklungsprozess eingebunden und verbessern so die Praxistauglichkeit und Akzeptanz sowie die Ausrichtung des Instrumentariums an den tatsächlichen Bedürfnissen. Dieses partnerschaftliche, partizipative Vorgehen scheint eine wichtige Voraussetzung dafür zu sein, dass METAP in der Klinik Fuß fassen konnte. (shrink)

What, normatively speaking, are the grounds of rational choice? This paper defends ‘comparativism’, the view that a comparative fact grounds rational choice. It examines three of the most serious challenges to comparativism: 1) that sometimes what grounds rational choice is an exclusionary-type relation among alternatives; 2) that an absolute fact such as that it’s your duty or conforms to the Categorial Imperative grounds rational choice; and 3) that rational choice between incomparables is possible, and in particular, all that is needed (...) for the possibility of rational choice is that one alternative is not worse than the others. Each challenge is questioned. If comparativism is correct, then no matter what normative theory you favor, your answer to the question, ‘What makes my choice rational?’ must be comparative in form. In this way, comparativism provides a framework for normative theorizing. (shrink)

Ruth Abbey presents a close study of Nietzsche's works, Human, All Too Human, Daybreak, and The Gay Science. Although these middle period works tend to be neglected in commentaries on Nietzsche, they repay careful attention. Abbey's commentary brings to light important differences across Nietzsche's oeuvre that have gone unnoticed, filling a serious gap in the literature.

If liberal theory is to move forward, it must take the political nature of family relations seriously. The beginnings of such a liberalism appear in Mary Wollstonecraft's work. Wollstonecraft's depiction of the family as a fundamentally political institution extends liberal values into the private sphere by promoting the ideal of marriage as friendship. However, while her model of marriage diminishes arbitrary power in family relations, she seems unable to incorporate enduring sexual relations between married partners.

This paper takes a sideways look at the controversial topic of educational assessment, raising the question: what place should the success/failure distinction have in an effective and humane educational system? Though the experience of failure may undermine the self-esteem that is conducive to learning, its possibility is clearly important educationally. Instead of asking whether teachers should be truthful about children’s achievements or dishonestly promote their self-esteem, we need to recognise a certain logical indeterminacy about what young children can do. Given (...) this, it is reasonable to presume in favour of many of their capacities rather than against them, for this is how children develop the confidence to act. This includes the confidence to fail as well as the confidence to succeed. It is argued that both are crucial for learning. (shrink)

This article examines the attempts by John Rawls in the works published after Political Liberalism to engage with some of the feminist responses to his work. Rawls goes a long way toward addressing some of the major feministliberal concerns. Yet this has the unintended consequence of pushing justice as fairness in the direction of a more comprehensive, rather than a strictly political, form of liberalism. This does not seem to be a problem peculiar to Rawls: rather, any form of liberalism (...) hospitable to feminist concerns must be, at the very least, a partly comprehensive, rather than a strictly political, doctrine. Resumen:El propósito de este ensayo es analizar en qué manera se producen las elaboraciones de conocimiento social, diferenciando el que es propiamente generado como construcción del mundo social del que, de un modo más específico, tiene pretensión de validez científica. Nuestra intención ha sido hacerlo poniendo el fundamento en esa intuición que se caracteriza por ser una forma de acceso al conocimiento cotidiano habitual, natural, sin complejas elaboraciones, intuitivo, en definitiva, que parece regir los posicionamientos, puntos de vista y percepciones (...) en nuestros días; y lo hace, además, de una forma que puede llamarse estética por las propias conceptualizaciones más clásicas, y también porque la estética parece ser uno de los signos de nuestros tiempos que ha quedado incorporado a los mecanismos por los que se produce el conocer intuitivo. This article considers the extent to which the debate about animal rights can be enriched by Richard Rorty’s theory of rights. Although Rorty’s work has enjoyed a lot of scholarly attention, commentators have not considered the implications of his arguments for animals. Nor have theorists of animal rights engaged his approach to rights. This paper argues that Rorty’s thinking holds a number of attractions for proponents of animal rights. It also considers some of its drawbacks. It is further argued that (...) Rorty’s thinking about rights avoids many of the problems that animal ethic of care theorists have found in rights discourse being applied to animals. Rorty’s work thus provides a valuable resource for bringing these two major strands within the animal ethics literature into closer theoretical kinship. (shrink)

This essay reviews David Halpin's Hope and Education, which aims to bring theories of hope and utopia to bear on the practical processes of schooling in contemporary Britain, and which sees education as an intrinsically hopeful and future-oriented process. It argues that the properly utopian character of Halpin's project is subverted by his espousal of a currently fashionable pragmatism, represented by Richard Rorty and Anthony Giddens, which insists that ‘good’ utopias must be realistic and practical. Utopian hope for a better (...) world, in which a transformed educational process will be central, is ambushed by this pragmatism and reduced to managerialism. (shrink)

Since the U.S. Supreme Court's decision in Dobbs vs. Jackson Women's Health Organization, a growing web of state laws restricts access to abortion. Here we consider how, ethically, doctors should respond when terminating a pregnancy is clinically indicated but state law imposes restrictions on doing so. We offer a typology of cases in which the dilemma emerges and a brief sketch of the current state of legal prohibitions against providing such care. We examine the issue from the standpoints of conscience, (...) professional ethics, and civil disobedience and conclude that it is almost always morally permissible and praiseworthy to break the law and that, in a subset of cases, it is morally obligatory to do so. We further argue that health care institutions that employ or credential physicians to provide reproductive health care have an ethical duty to provide a basic suite of practical supports for them as they work to ethically resolve the dilemmas before them. We examine how UK listed companies set executive pay, reviewing the implications of following best practice in corporate governance and examining how this can conflict with what shareholders and other stakeholders might perceive as good behaviour. We do this by considering current governance regulation in the light of interviews with protagonists in the debate, setting out the dilemmas faced by remuneration-setters, and showing how the processes they follow can lead to ethical conflicts. Current 'best' practice governing executive pay includes the (...) use of market benchmarks to determine salary and bonus levels, significant levels of performance-related pay, the desire for executives to hold equity in their companies, the disclosure of total shareholder return compared to an index, and a perceived need for conformity, in order to grant legitimacy to policies. Whilst each of these may in some circumstances lead to good practice, each has the potential to cause dysfunctional behaviour in executives. Overall, we conclude that although best practice might drive good executive behaviour that coincides with the company's and key stakeholders' objectives, there are many reasons why it should not. The study draws attention to the transfer of management theories and practices from traditional capitalist countries such as the USA and UK to post-socialist countries that are currently experiencing radical change as they seek to introduce market reforms. It is highlighted that the efficacy of this transfer of management theories and practices is, in part, dependent upon the extent to which work-related attitudes and values vary between traditional capitalist and former socialist contexts. We highlight that practices such as Human Resource (...) Management (HRM) and Organization Development (OD) are inextricably associated with conceptions surrounding culture and society, as well as to variables such as job satisfaction and organisational commitment. The main aim of this study is to compare various attitudes and values of employees in traditional capitalist countries and post-socialist countries. On the basis of the findings of an attitudinal survey of (N = 5914) workers in 15 countries we conclude that certain aspects of the attitudes and values of workers in post-socialist countries and traditional capitalist countries differ significantly. Specifically, these differences were found in respect of context-related and job-related attitudes, and also in relation to the importance that the respondents attached to the subject of ethics more generally. The implications of the study are discussed particularly in relation to the transfer of management theory and practices between traditional capitalist and post-socialist contexts. (shrink)

In this paper we aim to show an intrinsic contradiction of contemporary Metaphysical Realism by focusing on the relation between the subject and the object. Metaphysical Realism considers facts and objects as being empirical, and therefore they are considered in relation to the subject, while at the same time facts are assumed to belong to an autonomous and independent reality. However, if a real object is considered to be independent from the subject, once it enters in a relation with the (...) latter, a real object must undergo an intrinsic transformation. However, since an object cannot avoid this transformation then recovering the real or “absolute” object from the perceived object is not possible. In this way, the inherent contradiction of the “absolute” as being determined, i.e., defined by virtue of a limit, is revealed. (shrink)

Teachers need grounded ethical confidence: an intellectual virtue analogous to courage. I distinguish this from SCAA's notion of teacher confidence, based on the ‘authority of consensus’. Such a notion is challenged by Wittgenstein's later philosophy. I argue that confidence in authority is deferential rather than intellectual, which is not what we want for teachers. As courage (according to Aristotle) is a mean between vices, grounded ethical confidence is a mean between tendencies to excessive and insufficient doubt (forms of ‘not knowing (...) one's way about’ philosophically.) It is the virtue of thinking well ethically, and knowing that one thinks well. (shrink)

Most of Christine Swanton’s quotations from and references to Nietzsche are drawn The Genealogy of Morals, Thus Spoke Zarathustra, and Beyond Good and Evil. I suggest that Human, All too Human and Daybreak, two of Nietzsche’s most neglected works, provide rich resources for Swanton’s interpretation of Nietzsche’s view of self-love and its defining role in genuinely ethical action. Self-love assumes a central place in these writings, as do its cognate concepts of egoism and vanity. I outline some of the reasons (...) why these two middle period writings recommend themselves powerfully for Swanton’s philosophical purposes. I examine to what extent passages on self-love from these neglected works nourish, but also to what extent they challenge or upset, the central place accorded to self-love in Swanton’s recalibration of virtue ethics. Sexual abuse by clergymen, poisoned water, police brutality—these cases each involve two wrongs: the abuse itself and the attempt to avoid responsibility for it. Our focus is this second wrong—the cover up. Cover ups are accountability failures, and they share common strategies for thwarting accountability whatever the abuse and whatever the institution. We find that cover ups often succeed even when accountability mechanisms are in place. Hence, improved institutions will not be sufficient to prevent accountability failures. Accountability mechanisms are tools (...) that people must be willing to use in good faith. They fail when people are complicit. What explains complicity? We identify certain human proclivities and features of modern organizations that lead people to become complicit in the wrongdoing of others. If we focus exclusively on the design of institutions, we will fail to constrain the perpetrators of wrongdoing. Understanding complicity is key to understanding accountability failures. (shrink)

John Locke's Some Thoughts Concerning Education began as a series of letters to his friend, Sir Edward Clarke. Written during the same period he was writing the final draft of An Essay Concerning Human Understanding, the Thoughts was first published in 1693. Locke was as concerned with cultivating the minds of adults as he was with childhood education. Of the Conduct of the Understanding addresses this concern. Locke's thoughts on education are part of his comprehensive epistemological, moral, and political reflections. (...) For this reason, this chapter begins by considering the Thoughts and the Conduct in turn for what they reveal of Locke's educational principles and recommended practices. Then, it turns to address the ways in which these writings on education can deepen our understanding of unresolved theoretical problems in Locke's thought, of key concepts such as freedom and reasonableness, and of the degree of coherence of his philosophy altogether. Is it more dangerous to call something evil or not to? This fundamental question deeply divides those who fear that the term oversimplifies grave problems and those who worry that, to effectively address such issues as terrorism and genocide, we must first acknowledge them as evil. Recognizing that the way we approach this dilemma can significantly affect both the harm we suffer and the suffering we inflict, a distinguished group of contributors engages in the debate with this series of timely (...) and original essays. This study contributes to our understanding of how work-related values, including ethics, are connected with the readiness to change in Estonian organizations. Research in Estonian companies involved 747 respondents. The author examined the influence of work-related values on attitude towards change and organizational learning. Empirical research in Estonian organizations indicates that work-related values predict attitude towards change and organizational learning. This study indicates the need for ethical conduct to achieve a competitive advantage in Estonia. Guidelines for managers and a model (...) of value-based change management are subsequently developed. Four key guidance points in the UNAIDS guidance document, Ethical Considerations in HIV Preventive Vaccine Research, are compared with analogous statements in three other recently issued documents dealing with international research. Those documents are: the Declaration of Helsinki, as revised in 2000; the report of the U.S. National Bioethics Advisory Commission, issued in 2001; and a current (2001) draft revision of the 1993 CIOMS International Ethical Guidelines for Biomedical Research Involving Human Subjects. The four guidance points compared with statements on (...) similar issues in the other three documents are Guidance Point 2, which deals with making available a safe and effective vaccine after trials are completed; the second half of Guidance Point 4, which requires that the desired outcome should potentially benefit the population from which research participants are drawn; Guidance Point 11, which discusses what should be provided to a control group in a vaccine trial; and Guidance Point 16, which addresses the care and treatment to be provided for trial participants who become infected with HIV during the trial. The analysis and comparison concludes that the UNAIDS guidance points are at least as ethically sound as analogous points in these other documents, and for the most part are ethically superior in providing greater benefits to research participants and to others. Nevertheless, they are subject to the criticism that they are too ‘aspirational’ and not sufficiently ‘pragmatic’. (shrink)

There is, indeed, a form of informational semantics that has this verificationist implication. The original definition of information given in Dretske's Knowledge and the Flow of Information (1981, hereafter KFI), when employed as a base for a theory of intentional representation or "content," has this implication. I will argue that, in fact, most of what an animal needs to know about its environment is not available as natural information of this kind. It is true, I believe, that there is one (...) fundamental kind of perception that depends on this kind of natural information, but more sophisticated forms of inner representation do not. It is unclear, however, exactly what "natural information" is supposed to mean, certainly in Fodor's, and even in Dretske's writing. In many places, Dretske seems to employ a softer notion than the one he originally defines. I will propose a softer view of natural information that is, I believe, at least hinted at by Dretske, and show that it does not have verificationist consequences. According to this soft informational semantics, a creature can perfectly well have a representation of Xs without being able to discriminate Xs from Ys. (shrink)
